Brahim Sanhaji
Sanhaji Music

Email: sales@sanhaji-music.com
These terms apply to consumers and business customers purchasing digital products from our online store.
Any mandatory statutory consumer rights remain unaffected.
## 2. Products
SANHAJI MUSIC STORE offers digital products for music production, including sample packs, audio loops, one-shots, sound libraries and, where available, software plugins.
All products are delivered digitally. No physical products are shipped.
The content, file formats, specifications and system requirements are described on the respective product pages.
Customers are responsible for verifying compatibility with their software and hardware before purchasing.
## 3. Orders and Contract Formation
Products displayed in the online store do not constitute a legally binding offer.
By completing checkout and submitting an order, the customer makes a binding offer to purchase the selected products.
The contract is concluded when we accept the order by email or make the purchased digital content available for download, whichever occurs first.
Customers can review and correct their order before submitting it.
Order confirmations are sent electronically to the email address provided during checkout.
We store the contract text. After placing an order, the customer receives the order details and these Terms & Conditions by email. Customers with a customer account can also view their past orders there. These Terms & Conditions can be viewed and saved at any time on our website.
The contract language is English.
## 4. Prices and Payments
All prices are displayed in the currency indicated in the store.
All prices are final prices and include the statutory value added tax (VAT). No additional VAT is added at checkout.
The final purchase price is shown during checkout before the order is submitted.
Payment is processed through the payment methods available at checkout.
Any promotional offers or bulk discounts are subject to the conditions displayed in the store.
No physical shipping charges apply to digital downloads.
## 5. Digital Delivery
Purchased digital products are generally made available for download after successful payment and fulfilment of any required conditions for immediate delivery.
Download access may be provided through the website, the order confirmation or a separate email.
Customers are responsible for downloading and securely storing their purchased files.
We recommend keeping backup copies of downloaded products.
Download links may have technical or time-based limitations. This does not affect statutory rights regarding the delivery of digital content.
If a download is unavailable, incomplete or defective, customers should contact sales@sanhaji-music.com.
## 6. Sample Pack License
All sample packs sold through SANHAJI MUSIC STORE are provided under a non-exclusive, worldwide, non-transferable, perpetual, royalty-free license, unless otherwise stated in the respective product description.
The license allows customers to use the purchased samples in their own creative productions, including commercial releases.
### Permitted Use
Customers may:
- Use samples in original musical compositions and productions.
- Release music containing the samples commercially.
- Use samples in music distributed through streaming platforms, record labels and digital stores.
- Edit, process, manipulate, layer and modify samples.
- Use samples in live performances, DJ productions and audiovisual projects.
- Use samples in film, television, advertising and video games as part of a finished creative work.
- Create music for clients and third parties.
No additional royalty payments or sample-specific credits are required for these permitted uses.
### Prohibited Use
Customers may not:
- Resell, redistribute or share the original sample files.
- Upload samples to file-sharing platforms for independent downloading.
- Include samples in other sample packs, sound libraries or competing downloadable sound products.
- Sell or distribute samples as standalone audio files, including substantially unchanged versions.
- Transfer, sublicense or distribute the sample library itself to third parties.
- Claim copyright ownership of the original sample recordings.
- Register individual samples in content identification systems in a manner that improperly restricts their use by other lawful license holders.
The license applies to the use of samples within finished creative works. Ownership of the original recordings remains with the respective rights holder.
## 7. Software Plugins
Where software plugins or other executable digital products are offered, customers receive a license to use the purchased software under the conditions specified for that product.
Specific software licenses or End User License Agreements (EULAs), where provided, take precedence over the general software licensing provisions of these Terms & Conditions.
Software compatibility, supported operating systems, plugin formats and activation requirements are described on the respective product pages.
Software may not be unlawfully copied, redistributed, sublicensed or made publicly available.
Statutory rights relating to software conformity and legally required updates remain unaffected.
## 8. Copyright and Intellectual Property
All original audio recordings, samples, software, graphics, artwork, logos, product descriptions and other protected content remain the intellectual property of SANHAJI MUSIC or their respective rights holders.
Purchasing a product grants the customer the applicable usage license but does not transfer ownership of the underlying intellectual property.
Any use outside the granted license requires prior authorization from the relevant rights holder.
## 9. Right of Withdrawal
### Withdrawal Instructions
**Right of withdrawal**
You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period will expire after 14 days from the day of the conclusion of the contract.
To exercise the right of withdrawal, you must inform us (Brahim Sanhaji, Sanhaji Music, Mahlower Str. 249, 14513 Teltow, Germany, e-mail: sales@sanhaji-music.com) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or e-mail). You may use the attached model withdrawal form, but it is not obligatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
**Effects of withdrawal**
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
### Early Expiry of the Right of Withdrawal for Digital Content
For digital content not supplied on a physical medium, such as downloadable sample packs or software, the statutory right of withdrawal expires when performance begins, provided that all applicable legal requirements are fulfilled.
In particular:
1. The customer has expressly consented to the supply of the digital content beginning before the end of the 14-day withdrawal period.
2. The customer has acknowledged that this consent results in the loss of the right of withdrawal once performance begins.
3. We have begun supplying the digital content.
4. The customer has received the legally required contract confirmation, including confirmation of the consent and acknowledgment.
Where these requirements are fulfilled, the customer loses the statutory right of withdrawal when the supply of the digital content begins.
If these requirements have not been fulfilled, the applicable statutory withdrawal rights remain unaffected.
## 10. Refund Policy
Due to the digital nature of our products, purchases are generally non-refundable once the statutory right of withdrawal has validly expired.
We do not offer voluntary refunds solely because a customer changes their mind or no longer wishes to use a downloaded product.
However, customers retain their statutory rights in cases involving defective, incomplete, inaccessible or non-conforming digital products.
If a product is defective or cannot be accessed, customers should contact:
sales@sanhaji-music.com
We will assess and resolve the issue in accordance with applicable consumer protection laws.
Nothing in this Refund Policy restricts mandatory statutory rights.
## 11. Model Withdrawal Form

## 12. Liability
We are liable without limitation for intentional misconduct, gross negligence, injury to life, body or health caused by negligence, and in other cases where liability cannot legally be restricted.
In cases of slight negligence involving a breach of essential contractual obligations, liability is limited to foreseeable damage typical for the contract, where legally permitted.
Essential contractual obligations are obligations whose fulfilment is necessary for the proper performance of the contract and on whose fulfilment customers may regularly rely.
Mandatory statutory liability, including applicable consumer protection and product liability provisions, remains unaffected.
## 13. Privacy and Data Protection
Personal data is processed in accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR).
Further information about the processing of personal data, payment providers, cookies and customer rights is available in our Privacy Policy.

## 15. Applicable Law
These Terms & Conditions are governed by the laws of the Federal Republic of Germany.
For consumers, this choice of law does not affect mandatory consumer protection rights applicable under the laws of their country of habitual residence where legally required.
## 16. Changes to These Terms
We reserve the right to update these Terms & Conditions to reflect legal, operational or technical changes.
The terms in effect at the time of purchase govern the respective contract.
Changes do not retroactively alter existing contracts without a valid legal basis.
